What this can look like
A broker says a deal is exempt from the Escrow Law. If the state asks, the broker must show that the broker’s role and the deal meet the legal conditions.
What the law says
The person claiming an exemption from California’s Escrow Law has to prove that the exemption applies.
The entire operative rule is one sentence: “the burden of proving an exemption or an exception from a definition is upon the person claiming it.” 1
The rule does not create an exemption. It decides who must prove that an exemption already found elsewhere—such as section 17006—fits the facts.
Why this rule exists
A person invoking an exemption cannot simply point to a job title or license. The person must show that the facts satisfy the exemption’s conditions.
For a broker, that includes the transaction-specific limits in section 17006(a)(4). For a lawyer, it includes the client-relationship and separate-business limits in section 17006(a)(2).
